Agency Terms of Service

1. Agreement & Single-Office Licensing
These Agency Terms of Service ("Terms") govern the provision of the Routine Check software platform to real estate agencies, licensed property management corporations, and principals ("Agency", "Subscriber", or "You") by Routine Check Pty Ltd ("Routine Check", "we", "us").
Single-Office Licensing Policy: Routine Check subscription plans are licensed strictly on a per-physical-office basis. Each active licence authorizes use exclusively by one registered corporate real estate entity or single branch office operating under a specific corporate real estate licence and Australian Business Number (ABN).
Franchise & Multi-Branch Networks: Sharing a single subscription licence across multiple physical branches, trading locations, or separate franchisee entities is strictly prohibited. Franchise groups, multi-office agency networks, or rent rolls exceeding 1,500 properties must obtain an authorized Multi-Office Enterprise Agreement by contacting sales@routinecheck.com.au.
2. Subscriptions, Billing & Cancellation
Routine Check provides tier-based subscription access based on active property management roll size:
- Agency Standard (Up to 500 Properties): $97 per week, billed monthly in advance at $420 per month (+ GST). Includes 1 licensed physical office location, unlimited routine inspections, and unlimited property manager seats.
- Agency Scale (Up to 1,500 Properties): $197 per week, billed monthly in advance at $850 per month (+ GST). Includes 1 licensed physical office location, unlimited routine inspections, unlimited seats, and custom agency landlord branding.
- Free Trial Period: Eligible new agencies receive a 14-day unrestricted trial. No credit card is required to initiate the trial. Continued access following the trial requires payment credential activation.
Billing & Cancellation: All fees are quoted and charged in Australian Dollars (AUD) subject to applicable Goods and Services Tax (GST). Subscriptions automatically renew monthly unless canceled. Agencies may cancel at any time via the self-service Stripe Customer Portal or dashboard settings. Upon cancellation, platform access continues uninterrupted through the end of the current paid billing cycle. Routine Check does not provide pro-rata refunds for partial months or unused inspection allocations.
3. Agency Responsibilities & Statutory Compliance
The subscribing Agency retains sole operational oversight of its residential tenancies and landlord communications:
- Statutory Tenancy Consents: The Agency is solely responsible for ensuring that offering tenant self-guided inspections complies with all relevant state and territory residential tenancy legislation, including but not limited to the Residential Tenancies Act 2010 (NSW), Residential Tenancies Act 1997 (VIC), Residential Tenancies and Rooming Accommodation Act 2008 (QLD), and corresponding Western Australian, South Australian, Tasmanian, and ACT statutes. The Agency warrants that it will obtain any tenant agreements or issue any required formal statutory notices before initiating inspection workflows.
- Editorial Review & Report Sign-Off: Routine Check provides an administrative review interface and automated compiler. The Agency property manager maintains full editorial responsibility for inspecting submitted photographs, requesting room retakes where quality is deficient, approving condition summaries, and authorizing delivery to landlords or property owners.
- Accurate Property Records: The Agency is responsible for maintaining accurate property addresses and boundary coordinates to ensure reliable geolocation geofencing verification.
4. Platform Availability & Support
Routine Check is provided on an "as-is" and "as-available" basis. We target 99.9% platform availability for routine self-service submissions, automated photo processing, and PDF compiler generation, excluding scheduled maintenance windows notified in advance.
Customer support is provided during Australian Eastern Standard Time (AEST/AEDT) business hours via email and direct dashboard support channels.
5. Limitation of Liability
To the maximum extent permitted by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)):
- Routine Check is not liable for indirect, incidental, punitive, special, or consequential damages, including loss of profits, loss of rent, property degradation, structural damages, tenancy disputes, tribunal claims (e.g., NCAT, VCAT, QCAT), or landlord compensation claims arising from or related to the use of self-guided tenant inspection reports.
- Our total cumulative liability arising out of or in connection with the platform or these Terms, whether in contract, tort (including negligence), statute, or equity, is limited to the total fees actually paid by the Agency to Routine Check in the three (3) months preceding the incident giving rise to liability.
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of the courts of New South Wales.
